Frequently Asked Questions – N4 Non-Payment
Can I evict a tenant immediately for non-payment of rent?
No. An N4 Notice provides a statutory notice period. If the tenant pays the arrears in full before the termination date, the tenancy continues.
If payment is not made, the landlord may file an L1 application with the Landlord and Tenant Board seeking termination and recovery of arrears.
What happens if the tenant pays before the hearing?
If the tenant pays all arrears and applicable filing fees before the hearing, the eviction portion of the application may be void.
However, proper documentation and accurate accounting remain important to ensure compliance and protect the landlord’s position before the Landlord and Tenant Board.
How long does the LTB process take?
Timelines vary depending on regional scheduling and current Landlord and Tenant Board volume.
